Privacy Policy

Who is responsible for your data

Underloop, Lda. is the data controller for the personal data described here. For any privacy question or request, email [email protected].

What we collect

  • Browsing data: when you visit our sites we collect information about your device and visit, such as browser type, IP address, time zone, the pages you view and the site that referred you. Analytics cookies are only used if you accept them in the cookie banner.

  • Newsletter data: the email address you give us when you subscribe.

  • Messages: your name, email address and anything you send us through the contact form or by email.

  • Order data: when you buy from the MXGPU Collection, your name, billing and shipping address, email address, phone number and order details. Payments are handled by our payment providers; we do not see or store your full card details.

Why we use it

  • To process and deliver your orders, issue invoices and provide customer support (to perform our contract with you).

  • To reply to your messages and booking, press or other enquiries (our legitimate interest in answering you, or steps you ask us to take before a contract).

  • To keep accounting and tax records (to meet our legal obligations).

  • To keep our sites secure, block spam on our forms and understand how our sites are used so we can improve them (our legitimate interests, and your consent where cookies are involved).

  • To send you our newsletter (your consent, which you can withdraw at any time, for example via the unsubscribe link in every email).

Who we share it with

We only share personal data with service providers that help us run MXGPU, and only for the purposes above:

  • Squarespace: website hosting, website statistics, newsletter sign-up and the contact form.

  • Google reCAPTCHA: protecting our forms from spam and abuse.

  • YouTube (Google): playing the videos embedded on our pages.

  • Atelier and our payment providers: the online shop, checkout and payments.

  • CTT: delivery of your orders.

We may also disclose data where the law requires it, for example in response to a lawful request from the authorities, or to protect our rights.

Some of these providers process data outside the European Economic Area, including in the United States. Where they do, the transfer is protected by the European Commission's Standard Contractual Clauses or the EU-US Data Privacy Framework.

How long we keep it

  • Order and invoice records: for as long as Portuguese tax and accounting law requires (currently 10 years).

  • Newsletter: until you unsubscribe.

  • Messages: for as long as needed to deal with your enquiry and any follow-up.

  • Other data: only as long as we need it for the purpose it was collected for.

Your rights

You have the right to access, correct or delete your personal data, to restrict or object to how we use it, to receive it in a portable format, and to withdraw your consent at any time. To exercise any of these rights, email [email protected].

You can also complain to the Portuguese data protection authority, the Comissão Nacional de Proteção de Dados (www.cnpd.pt).

Changes to this policy

We may update this page from time to time. The date at the top shows when it last changed.

Cookie Policy

Cookies are small files a website stores in your browser. We use them as follows:

  • Strictly necessary: set by Squarespace to run the site securely, keep your cart and remember your cookie choice. These do not need your consent and cannot be switched off.

  • Analytics: Squarespace's own statistics cookies, which tell us how visitors use the site. These are only set if you accept them.

  • Third-party content: Google reCAPTCHA sets a cookie when you use our forms, to tell people from bots. Embedded YouTube videos may set cookies or similar technologies when they load or play; see Google's privacy policy at policies.google.com/privacy.

When you first visit, a banner asks for your choice. You can change it at any time with the cookie preferences button on the site, or by deleting cookies in your browser settings.

Sales Terms & Conditions

These terms apply to purchases made at the MXGPU Collection (mxgpu.atelier.sale). The seller is Underloop, Lda.

Shipping

We ship with CTT, the Portuguese postal service. If you need urgent shipping, please email [email protected] before placing your order.

After you order, you will receive an order confirmation email. When your order is dispatched, you will receive a second email with tracking details.

Orders are usually processed and shipped within one working day. Estimated delivery times:

  • Portugal: up to 2 working days

  • European Union: up to 7 working days

  • Rest of the world: up to 14 working days

These are estimates. Delays caused by carriers, customs or other circumstances outside our control can happen; if your parcel is late, contact us and we will help trace it.

International duties and taxes

Orders shipped outside the European Union may be charged customs or import duties by the destination country. These are set by each country, are charged on arrival, and are paid by the recipient; we have no control over them and cannot refund them.

If a parcel is returned to us because duties were not paid or delivery was refused, the cost of the return shipping is also charged to the buyer.

Right of withdrawal (14 days)

If you are buying as a consumer, you can cancel your order within 14 days of the day you, or someone you nominate, receive the goods, without giving a reason.

To cancel, email [email protected] with your order number and a clear statement that you are cancelling. You can use the model form below, but you don't have to.

Send the items back within 14 days of telling us, unused and in their original condition. The direct cost of returning the items is paid by you.

We will refund the amount you paid, including standard delivery costs, within 14 days of receiving your cancellation, using the same payment method you used. We may wait to refund until we receive the items back or you send proof that you have returned them.

The right of withdrawal does not apply to:

  • sealed audio or video recordings (such as vinyl records, CDs and cassettes) that have been unsealed after delivery;

  • items made to order or personalised for you;

  • sealed items that cannot be returned for health or hygiene reasons once unsealed.

Exchanges

In addition to your legal rights, we offer exchanges on items that are not on sale:

  • Request the exchange within 15 days of the shipping date.

  • Items must be unworn, unused and in their original condition, with packaging and tags intact.

  • The cost of shipping the item back to us is paid by you.

  • Once we have received and checked the item, we will issue store credit for its purchase price (excluding shipping), which you can use in the MXGPU Collection.

Faulty or incorrect items

All goods are covered by the legal guarantee of conformity (3 years in Portugal). If an item is faulty, or we sent the wrong item or size, email [email protected] with your order number and a description or photo of the problem, and we will repair it, replace it or refund you at no cost to you.

Shipping details

Please make sure your shipping details are correct when you place your order. We are not responsible for orders that do not arrive because of an incorrect address. If an order is returned to us because of an incorrect address or because it was not collected, the cost of sending it again will be charged to you.

Complaints and disputes

If you have a problem with your order, please contact us first at [email protected] and we will do our best to resolve it.

You can also file a complaint in the electronic Complaints Book (Livro de Reclamações) at www.livroreclamacoes.pt.

If we cannot reach an agreement, you can refer the dispute to an alternative dispute resolution body: the Centro de Arbitragem de Conflitos de Consumo de Lisboa (www.centroarbitragemlisboa.pt), Rua dos Douradores 108-116, 2.º, 1100-207 Lisboa. More information is available on the Consumer Portal at www.consumidor.gov.pt.

Applicable law

These terms are governed by Portuguese law. This does not affect any mandatory consumer protection you are entitled to under the law of the country where you live.
